TERMS AND CONDITIONS OF SALE

Camping Ma Prairie is a 253-place campsite covering an area of 4.5 hectares and is accessible to people with disabilities.

1- SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions govern all sales of holidays made by Camping Ma Prairie or on the www.maprairie.com website. They form an integral part of any contract concluded between the campsite and its customers.
In order to take full advantage of the services offered by Camping Ma Prairie, we recommend that you carefully read the general terms and conditions below, which govern the sale of stays. Booking a stay implies full acceptance of these terms and conditions.

2- BOOKING CONDITIONS

  1. Reservations only become effective once the campsite has agreed to them, either after receipt of the deposit and the duly completed and signed booking contract, or after acceptance of the general terms and conditions of sale when booking online.
  2. The pitch number is never contractual and is allocated subject to availability.
  3. Reservations are only binding on the campsite if the campsite has accepted them, which the campsite is free to do or refuse depending on availability and, in general, any circumstance likely to affect the execution of the reservation made.
  4. The campsite offers family-oriented holidays in the traditional sense, with accommodation specially designed for this purpose. The campsite reserves the right to refuse any booking which is contrary to this principle or which seeks to divert from it.
  5. The reservation of a campsite pitch or accommodation is made on a strictly personal basis: only the persons named on the contract will be admitted to the pitch or accommodation. The baby counts as a person in its own right.
  6. Minors must be accompanied by their parents or legal guardians.

3- SERVICES

1. CAMPING PITCH :

Pitches vary in size. They can accommodate from 2 to 6 people, including babies. We adapt the allocation of your pitch according to the size of your equipment. Please call us to discuss your requirements.

The basic rate is all-inclusive and includes a pitch for 1 piece of equipment (tent, caravan or camper van), for 1 or 2 people, 1 electricity connection, access to sanitary facilities and reception facilities.

2. RENTALS:

Rental accommodation is fully equipped (furniture, crockery), with or without sanitary facilities. Rental includes water, gas and electricity consumption, and the number of people may not exceed the accommodation's capacity. Babies count as one person. Bed linen, towels and end-of-stay cleaning are not included in the basic rate.

3. GROUP RESERVATION

The campsite reserves the right to refuse access to the campsite to families or groups whose number of participants exceeds the capacity of the accommodation rented. A group is any family or group of individuals who know each other and travel together, booking more than 3 accommodations or pitches under the same person or individually, for common or overlapping dates of stay and for the same reasons. All requests for group bookings must be made in advance to the campsite, which reserves the right to accept or refuse such bookings.

4- RATES

Prices are subject to change. The campsite reserves the right to change prices at any time. The rate applicable to the stay is the rate in force on the day of booking, subject to availability. When the customer requests a quote, its validity is indicated on the document. After the validity date, the price indicated is no longer guaranteed. 

The advantages or promotions offered by the campsite after the reservation date cannot be applied to a reservation that has already been paid for in full or in part.

Prices are quoted in euros (including VAT at the current rate) and are per night, with a minimum number of nights depending on the period.

A management fee applies to all pitch and rental accommodation bookings, regardless of duration. The amount is fixed and non-refundable.

Customers who already know the campsite can choose a pitch number when booking, subject to availability. For this option, a "Choice of pitch" supplement will be charged.

5- TOURIST TOURIST TAX

The tourist tax is compulsory, and its amount is set by decision of the Perpignan Méditerranée community of communes. It applies to people over 18 and must be paid no later than the day of your arrival.

 

6- NO RIGHT OF WITHDRAWAL

The legal provisions relating to the right of withdrawal in the case of distance selling, as set out in the French Consumer Code, do not apply to tourist services (article L.121-19 of the French Consumer Code).

Thus, for any order of a stay with the campsite, the customer does not benefit from any right of retraction.

7- TERMS OF PAYMENT

For bookings made more than 15 days before the arrival date, a deposit of 25% of the price of the services booked must be paid at the time of booking.

Payment of the balance of your reservation must be made no later than 15 days before your arrival.

For bookings made less than 15 days before the arrival date, the full amount of the stay must be paid.

You will be invoiced for the period booked as indicated on the contract. No reduction will be made for late arrivals or early departures.

8- MODIFYING YOUR RESERVATION

Customers may request changes to their stay, dates or type of accommodation, at no extra chargeupon written request by post or e-mail. These modifications may be accepted or refused by the campsite depending on availability. No postponement will be accepted for the following season. In the absence of a modification, the customer will have to carry out his stay in the initial conditions of reservation or to cancel it according to the conditions of cancellation.

Any increase in the length of stay will be subject to availability and the current rates.

Any request to reduce the length of your stay will be considered as a partial cancellation and will be subject to the cancellation and interruption terms and conditions.

9- UNUSED SERVICES 

In the event of early departure, late arrival or partial cancellation, the dates of stay indicated on the booking confirmation will be invoiced. After 24 hours without any news from you, the Management will dispose of the Mobil Home or the pitch which is the object of the contract.

 

10- CANCELLATION

CANCELLATION BY THE CAMPSITE :

In the event of cancellation by the campsite, except in cases of force majeure, the stay will be reimbursed up to the amount of payments received at the date of cancellation. This cancellation cannot give rise to the payment of damages.

Any booking not settled within the time limit specified in the general terms and conditions of sale will be cancelled.

CANCELLATION BY THE CUSTOMER

CANCELLATION INSURANCE

We advise you to take out optional cancellation insurance, which must be taken out and paid for in full at the time of booking. This contract is offered by Compagnie GRITCHEN TOLEDE ET ASSOCIES "Campez Couvert" Orias N° 150 004 26, whose general conditions can be downloaded from our website or requested by email.

The premium represents 4% of the total cost of your stay (excluding booking fees and taxes).

 

YOU ARE CANCELLING AND HAVE TAKEN OUT CANCELLATION COVER

All sums paid by you, excluding cancellation insurance and management fees, are covered by the guarantee according to the general cancellation conditions available on our sales site (Compagnie GRITCHEN "CAMPEZ COUVERT"). Once you have informed the campsite of your cancellation, it is your responsibility to notify the insurance company. YOU CANCEL YOUR HOLIDAY WITHOUT TAKING OUT CANCELLATION INSURANCE

  • Case 1: Cancellation more than 30 days prior to arrival:

The deposit paid will be refunded, less non-refundable administration costs. 

  • Case 2: Cancellation from 30 days to 15 days before arrival date 

The deposit paid will be retained by the campsite as a cancellation fee, less non-refundable administration costs. 

  • Case 3: Cancellation less than 15 days before arrival date 

Less than 15 days before the arrival date or if you do not show up on this date : the total amount of your stay (whether paid or not) will be retained as a cancellation fee.

 

11- COURSE OF YOUR STAY 

1. ARRIVALS

In the event of an unannounced delay, the rental/site becomes available 24 hours after the arrival date stated on the booking contract. After this time, and in the absence of a written message, the reservation is cancelled and the sums paid remain the property of the campsite (non-refundable).

  • Locations : 

Arrivals are from 3:00 p.m. in high season, any day of the week, and from 2:00 p.m. in low season. A deposit of €20 is required for the badge used to open the gates.

  • Rental accommodation:

For rental accommodation, we welcome you from 5:00 pm on the day of arrival in high season. In low season, we can welcome you from 3:00 pm. When you hand over your keys, you will be asked to pay a deposit of €250 for the badge used to open the gates and for the guarantee for the equipment provided.

2. DURING YOUR STAY

It is the camper's responsibility to be insured. Campers are responsible for looking after their personal belongings (bicycles, cell phones, laptops, towels, etc.) and must have third-party liability insurance for their equipment (caravan, tent, camper van, etc.).

The campsite declines all responsibility for damage to the camper's equipment not caused by the camper.

All customers must comply with the campsite rules and regulations, which will be given to you on the day of your arrival and posted at the campsite entrance.

Each tenant is responsible for any disturbance or nuisance caused by persons staying with or visiting him/her. Any disturbance caused intentionally and in spite of the recommendations or interventions of the campsite staff may result in immediate termination of the contract, without entitlement to reimbursement.

3. DEPARTURES 

All departure formalities must be completed the day before at the latest. For late departures, an additional day may be charged at the current nightly rate.

  • Locations :

Pitches must be vacated by 11:00 am on the day of departure. 

  • Rental accommodation :

Rental accommodation must be vacated by 10:30 a.m. on the day of departure indicated on your contract. The accommodation must be left in a clean and tidy condition and the inventory may be checked.. Any broken or damaged equipment will be charged to you, as will the restoration of the premises, should this prove necessary. The security deposit will be returned to you at the end of your stay, less any compensation deducted from the supporting invoice for any damage noted in the departure inventory. Withholding the security deposit does not preclude additional compensation if the cost of repair exceeds the amount of the deposit.

If the accommodation has not been cleaned before your departure, a cleaning fee will be charged at the price corresponding to your type of accommodation. 

If you are unable to attend the inventory of fixtures (departure outside reception opening hours), the deposit will be returned to you by post, with the exception of the cleaning deposit, which remains the property of the campsite.

12- ANIMALS

Pets (except1st and2nd category dogs) are welcome at an additional cost, except in the LUXURY rental range. They must be registered on arrival. They must be kept on a leash at all times, identified and have up-to-date vaccination records, and are the responsibility of their owner. They must not be left alone on your pitch or in your accommodation.

13- AQUATIC AREA :

Access to the aquatic area is regulated. Instructions are posted at the entrance to the aquatic area and relayed by our staff. We remind you that :

Swimming is unsupervised. Children must be accompanied and bathe under the responsibility of their parents or legal guardians. Access to the pools is free and strictly reserved for campsite guests. Visitors are not allowed in the pool.

Only tight-fitting lycra briefs, boxer shorts, bikinis or 1-piece swimsuits are permitted. Swim shorts or other swimwear are not permitted.

14- LIABILITY OF THE CAMPSITE

The customer expressly acknowledges that the campsite cannot be held responsible for the communication by its partners or by any third party of false information mentioned in guides or websites, in particular photos, descriptions, activities and facilities, leisure activities, services and dates of operation. All photos and text used in the brochure and on the campsite website are non-contractual. They are for information purposes only. It may happen that certain activities or facilities offered by the campsite and indicated in the description on the website or in the brochure are cancelled, particularly for climatic reasons or in the event of force majeure as defined by the French courts.

15- IMAGE RIGHTS

You authorize the campsite, or any person appointed by the campsite, to photograph, record or film you during your stay, and to use said images, sounds, videos and recordings in all media (in particular the website or web page, Facebook, in all promotional or presentation media and in tourist guides). This authorization applies both to you and to persons staying with you. Its purpose is to promote and animate the campsite and may in no way damage your reputation. This authorization is granted free of charge for all countries and for a period of 10 years.

16- INFORMATION TECHNOLOGY AND PRIVACY

The information you give us when you place your order will not be passed on to any third party and is considered confidential by the campsite. It will be used solely by the campsite to process your order and to reinforce and personalize the communication and services reserved for campsite customers.

In accordance with Articles 39 et seq. of the French Data Protection Act no. 78-17 of January 6, 1978, amended in 2004, any person may obtain access to and, where appropriate, rectification or deletion of information concerning him or her.

17- DISPUTES

 Any complaint concerning the non-conformity of the services provided in relation to the contractual commitments may be notified by post or e-mail to the campsite management.

Mediation : If you are not satisfied with Camping's response, you can contact the CM2C mediation center within one month of receiving these letters or e-mails.
